Legally Binding Agreement
Please read these Terms & Conditions (“Terms”) carefully before using the website, PWA application, and safe deal escrow services provided by HARPS Escrow Limited (“HARPS”). By creating an account, posting a marketplace listing, or initiating an escrow transaction, you agree to be bound by these Terms and our Privacy Policy.
1Escrow Safe Deal Mechanics & Custody
HARPS acts as an independent, institutional third-party escrow agent facilitating transactions between buyers and sellers:
Deposit & Custody: When a buyer initiates or funds a deal, the total consideration is charged through Paystack and held in an isolated institutional escrow account.
Seller Dispatch: The seller is notified to dispatch physical goods or fulfill digital milestones only after funds have been verified and secured.
Inspection Window: The buyer has a standard forty-eight (48) hour inspection window upon confirmed delivery to inspect goods or verify digital deliverables.
Release of Funds: Funds are released to the seller's wallet balance immediately upon the buyer's explicit confirmation, or automatically upon expiration of 48 hours without an open dispute.
Platform Escrow Limit: Direct automated escrow transactions are capped at ₦50,000 per deal. Transactions exceeding ₦50,000 proceed as negotiated direct trades with seller contact.
2Wallet Balances, Payouts & Bank Details
Wallet Balances: Balances represent net funds released from completed escrow transactions, referral rewards, or approved refunds.
Bank Account Resolution: Sellers must provide a valid 10-digit Nigerian NUBAN bank account number matching their registered identity. Account details are resolved and verified via Paystack.
Payout Timelines: Withdrawals to Nigerian commercial banks and licensed microfinance banks are processed 24/7 via automated NIBSS/Paystack transfer rails.
Account Masking: For your security, bank account numbers displayed within application views are masked to conceal full account details.
3Dispute Resolution & Admin Mediation
In the event that goods arrive damaged, do not match the listing specifications, or the seller fails to deliver within the agreed timeframe:
Either party may file a formal Dispute prior to fund release, which immediately freezes the escrow vault.
Both buyer and seller are required to submit photographic, tracking, or chat evidence through the deal room.
HARPS certified dispute mediators investigate submissions and issue a final determination (full refund to buyer, release to seller, or mutually agreed split).
Admin mediation decisions are final and binding within the HARPS platform ecosystem.
4Prohibited Goods & Circumvention of Escrow
Strictly Prohibited Items
Users may not list, advertise, or transact in: firearms, ammunition, illicit narcotics, prescription drugs, stolen merchandise, cloned debit cards, phishing services, human organs, or any items prohibited by the Criminal Code Act of Nigeria or EFCC directives.
Escrow Circumvention: Urging traders to pay off-platform via direct bank transfer to bypass safety checks constitutes a violation of these Terms and will result in immediate permanent account termination and forfeiture of verified status.
5Account Termination & Suspension
HARPS reserves the unilateral right to suspend, freeze, or terminate any account found engaging in fraudulent listings, identity theft, abusive conduct, or compliance breaches. Banned user identifiers are permanently blacklisted to protect the marketplace community.
6Limitation of Liability & Governing Law
HARPS Escrow Limited shall not be liable for indirect, punitive, or consequential damages resulting from courier shipping delays, off-platform communications, or user misrepresentations. These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
